Terms of Service

By accessing or using Recreate ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service. These Terms apply to all visitors, registered users, and paying subscribers.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

You must be at least 13 years old to use Recreate. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into this agreement. If you are using Recreate on behalf of a business, you represent that you are authorised to bind that business.

Recreate uses Google OAuth for authentication. You are responsible for maintaining the security of your Google account. We are not liable for any loss or damage resulting from unauthorised access to your account.

You may not create multiple accounts to circumvent usage limits. We reserve the right to suspend or terminate accounts that abuse free tier allowances or attempt to manipulate the credit system.

Free plan. Free accounts receive a limited number of daily AI actions and uploads. These reset daily and do not roll over. Free plan outputs are subject to the same ownership terms as paid plans.

Pro and Business plans. Paid plans are billed monthly on a recurring basis. Subscription fees are charged in advance for each billing period. You authorise Stripe to charge your payment method on file at renewal.

Credits. Credits are purchased or included with paid plans and are used for AI generation, editing, and processing. Credits expire when your subscription ends or your account is closed. Credits are non-refundable unless required by applicable law.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not offer prorated refunds for partial billing periods, except where required by law.

Price changes.We may change plan prices with at least 30 days' notice. Your subscription will renew at the new price unless you cancel before the renewal date.

You agree not to use Recreate to:

• Generate, store, or distribute illegal content of any kind
• Create content that sexualises minors (CSAM) — zero tolerance; immediate account termination and reporting to authorities
• Produce content that harasses, defames, or threatens individuals
• Generate deepfakes of real people without their consent for deceptive purposes
• Infringe third-party intellectual property rights
• Attempt to reverse-engineer, scrape, or otherwise abuse our APIs
• Automate access in a manner that places unreasonable load on the Service
• Resell access to the Service or use it to build a competing service without written permission

We reserve the right to remove content and suspend or terminate accounts that violate these rules, at our sole discretion, with or without notice.

Your inputs. You retain ownership of any source images, text prompts, and other materials you provide to the Service. By uploading content you grant us a limited licence to process it solely to provide the Service.

AI-generated outputs. Subject to your compliance with these Terms and applicable AI provider policies, you own the commercial rights to images generated by Recreate under a paid plan. Free plan outputs may be used for personal and non-commercial purposes.

Our platform. The Recreate platform, codebase, branding, and original content remain the exclusive property of Recreate. You may not copy, reproduce, or create derivative works based on our platform without written permission.

Note: Output ownership is also subject to the terms of the underlying AI model providers (Recraft AI, OpenAI, etc.). We recommend reviewing their terms for commercial use.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will meet your specific requirements. AI-generated images are probabilistic outputs — quality and accuracy are not guaranteed.

TO THE FULLEST EXTENT PERMITTED BY LAW, RECREATE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) USD $100.

You agree to indemnify and hold harmless Recreate and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

We may suspend or terminate your access to the Service at any time for violation of these Terms, illegal activity, or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

You may delete your account at any time from your account settings. Deletion is permanent and we cannot recover your data after deletion is complete.

These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms shall be resolved through binding arbitration or in the courts of the jurisdiction in which Recreate operates, except where prohibited by law.
